This website is operated by ERUDITEJASMINE UNIPESSOAL LDA (trading as CorkMart). Throughout the site, the terms “we”, “us” and “our” refer to CorkMart. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
SECTION 2 - PRODUCTS AND NATURE OF CORK (DISCLAIMER)
2.1. Natural Material: Cork is a 100% natural product. We have made every effort to display the colors and textures of our products accurately. However, you acknowledge that slight variations in color, porosity, grain, and texture are intrinsic characteristics of the raw material and are not considered defects.
2.2. Customization: For personalized products (e.g., laser-engraved stoppers, branded yoga mats), the customer warrants that they hold the necessary intellectual property rights for any logos or images provided. CorkMart reserves the right to refuse orders that may infringe on third-party rights or contain offensive content.
2.3. Availability: We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products are subject to change at any time without notice at our sole discretion.
SECTION 3 - ORDERS AND B2B/B2C DISTINCTION
3.1. Order Acceptance: Your order is an offer to purchase. CorkMart reserves the right to accept or decline your order for any reason.
3.2. B2B (Business) vs. B2C (Consumer):
- B2C (End Consumer): Orders for personal use are processed immediately upon payment confirmation.
- B2B (Professional/Reseller): Large volume orders may require specific production times. For custom bulk orders, production begins only after 100% payment confirmation (or as agreed in specific Net Terms).
3.3. Cancellation: Once a customized/personalized order has entered the production phase, it cannot be cancelled or refunded.
SECTION 4 - PRICES, TAXES AND PAYMENTS
4.1. Currency: Prices are listed in Euros (€).
4.2. VAT & Taxes:
- European Union: VAT is applied at the legal rate for B2C customers. B2B customers with a valid VIES VAT number are exempt (Reverse Charge).
- Rest of the World (Export): Prices are VAT-exclusive. Import duties, taxes, and brokerage fees at the destination country are the sole responsibility of the customer.
4.3. Payment Methods: We accept major credit cards, PayPal, and Apple Pay. For B2B orders exceeding €5,000, we may require Bank Wire Transfer.
SECTION 5 - SHIPPING, DELIVERY AND INCOTERMS
5.1. Delivery Terms:
- Standard (B2C): We ship via express carriers (UPS/DHL/FedEx) under DAP (Delivered at Place) terms. We organize the transport, but the customer is responsible for import duties (if outside the EU).
- Ex-Works (B2B Option): Professional customers may choose "Ex-Works" at checkout (or by request). In this case, the customer arranges pickup at our warehouse using their own forwarder. Our liability ends once goods are made available to the carrier.
5.2. Freight Quotes: For bulk orders requiring air or sea freight (pallets/containers), shipping costs will be calculated separately and invoiced before dispatch.
5.3. Liability: We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.
SECTION 6 - RETURNS AND REFUND POLICY
6.1. Right of Withdrawal (EU Consumers): B2C customers in the EU have the right to return non-customized goods within 14 days of receipt, without justification.
6.2. EXCEPTION FOR CUSTOMIZED PRODUCTS:
Pursuant to Article 17 of DL n.º 24/2014 (and EU Consumer Rights Directive), the right of withdrawal does NOT apply to goods made to the consumer's specifications or clearly personalized.
Therefore, we do not accept returns or exchanges for custom-printed cork products, stoppers with custom sizes/logos, or any made-to-order items, unless a manufacturing defect is proven.
6.3. Defects: In case of a manufacturing defect, please contact info@corkmart.com within 48 hours of delivery with photos of the issue.
SECTION 7 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, images, graphics, and the design thereof, are owned by Eruditejasmine Unipessoal Lda / CorkMart and are protected by copyright and other intellectual property laws. You must not reproduce, distribute, or modify any of the material without our prior written consent.
SECTION 8 - THIRD-PARTY LINKS
Certain content, products, and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.
SECTION 9 - PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy.
SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee that your use of our service will be uninterrupted or error-free.
In no case shall Eruditejasmine Unipessoal Lda, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of any of the service or any products procured using the service.
SECTION 11 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless CorkMart and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.
SECTION 12 - GOVERNING LAW AND JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Portugal.
Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the Courts of Porto, Portugal.
SECTION 13 - ALTERNATIVE DISPUTE RESOLUTION (RAL)
In the event of a consumer dispute, the consumer may contact an Alternative Dispute Resolution Entity (RAL), such as the CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo). More information at Consumer Portal: www.consumidor.pt.
