These Terms of Service govern the use of CorkMart.com and purchases made through CorkMart's online store, quotations and other sales channels.

These Terms should be read together with our Shipping Policy, Returns, Refunds & Withdrawal Policy, Privacy Policy and Legal Notice.

2. Scope of These Terms

These Terms apply to customers purchasing from CorkMart and to users accessing CorkMart.com.

A Consumer is a natural person purchasing primarily for purposes outside their trade, business, craft or profession.

A Business customer is a company, professional, reseller, contractor, institution or other person purchasing primarily for business, commercial, professional or industrial purposes.

Mandatory Consumer rights are not excluded or reduced by these Terms.

Where CorkMart and a Business customer agree specific written terms in a quotation, pro forma invoice, purchase agreement or other written contract, those specifically agreed terms prevail for the relevant order.

3. Use of CorkMart.com

Users must use CorkMart.com lawfully and must not interfere with the operation, security or integrity of the website.

You must not use the website to transmit malicious software, conduct fraudulent activity, submit deliberately false information, infringe third-party rights, or carry out abusive automated activity.

CorkMart may reasonably restrict access where necessary to protect the website, customers, payments, systems or business from fraud, abuse or security threats.

4. Product Information and Natural Cork

Cork is a natural material. Variations in colour, grain, porosity, pattern, density, shade and surface texture are normal characteristics of genuine cork.

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications and technical information are accurate.

Product images may vary slightly from the physical product because of natural material variation, production batches, photography, lighting and display settings.

Natural variations consistent with the product description, samples and reasonable manufacturing tolerances do not, by themselves, constitute a defect. This does not limit any statutory rights relating to defective or non-conforming goods.

5. Samples and Batch Variation

Samples provide a representative indication of colour, grain, texture and finish. Because cork is a natural material, a sample cannot guarantee an identical appearance in a later production batch.

Customers requiring strict batch, colour or appearance consistency for a project should contact CorkMart before ordering so that the requirement can be assessed.

6. Orders and Availability

When you submit an order through CorkMart.com, the website will provide electronic confirmation that the order has been received.

Orders remain subject to payment authorization, product availability, shipping eligibility and reasonable fraud and security checks.

CorkMart may cancel an order where it cannot reasonably be fulfilled, including because of product unavailability, an obvious pricing or technical error, payment failure, shipping restrictions or suspected fraud.

If CorkMart cancels an order that has already been paid, the amount paid for the cancelled goods will be refunded using the applicable payment method.

7. Customized and Made-to-Specification Products

Customized products include goods produced according to customer specifications, such as cut-to-size, made-to-measure, laser-engraved, printed, branded or otherwise personalized products.

The customer is responsible for checking specifications supplied or approved by them, including measurements, quantities, artwork, spelling, logos, colours and files.

Once production, cutting, engraving or personalization has begun, cancellation may no longer be possible where permitted by applicable law.

Consumer withdrawal rights may not apply to goods made according to the Consumer's specifications or clearly personalized, as provided by applicable law.

Customers providing logos, artwork or other protected material confirm that they have the necessary rights or permission for CorkMart to use that material for the requested order.

8. Prices, Taxes and Currency

Prices are displayed in Euros (€) unless another currency is expressly shown.

Prices displayed to Consumers in applicable European Union markets include VAT where required by law.

The applicable tax treatment may depend on the delivery destination, customer status and information provided during checkout.

Eligible Business customers with valid tax information and exports outside the European Union may be subject to different VAT treatment where legally applicable. The applicable amount will be reflected in the checkout, invoice or written quotation.

Orders delivered outside the European Union may be subject to destination-country import VAT, duties, customs charges or brokerage fees. These charges are governed by our Shipping Policy and applicable destination-country rules.

CorkMart may update prices for future orders at any time. Price changes do not affect an order already accepted, except where correction is permitted by applicable law.

9. Payment

Depending on destination, device, order value and payment eligibility, payment methods available at checkout may include:

• credit and debit cards;
• Apple Pay;
• Google Pay;
• Scalapay.

The payment methods actually available for an order are those displayed during checkout.

Scalapay transactions are also subject to Scalapay's applicable eligibility requirements and customer terms.

Orders may be delayed or cancelled if payment is declined, reversed, cannot be verified or is reasonably suspected of fraud.

Business, wholesale, custom or high-value orders may be subject to separate written payment arrangements agreed with CorkMart.

10. Shipping and Delivery

CorkMart ships from Portugal to supported destinations.

Preparation times, carriers, shipping services, rates, free-shipping thresholds, estimated transit times, international customs conditions and special freight arrangements are described in our Shipping Policy.

The shipping option and price displayed and accepted at checkout apply to the order, subject to the conditions stated in the Shipping Policy.

Customers are responsible for providing complete and accurate delivery information and for reasonably cooperating with carriers or customs authorities where necessary.

11. Returns, Refunds and Withdrawal

Returns, refunds, cancellations, damaged goods and the statutory Consumer right of withdrawal are governed by our Returns, Refunds & Withdrawal Policy.

Consumers purchasing eligible goods online generally have a 14-calendar-day statutory withdrawal period, subject to the applicable legal conditions and exceptions.

Business purchases are not covered by the Consumer statutory right of withdrawal.

12. Legal Guarantee and Product Conformity

Consumer purchases benefit from the statutory guarantee of conformity provided by applicable Portuguese and European consumer law.

Under Portuguese law, new movable goods are generally covered for lack of conformity for 3 years from delivery.

13. Technical Products, Installation and Intended Use

Certain CorkMart products are intended for construction, flooring, acoustic, insulation, industrial, craft or other technical applications.

Customers should review the available product specifications and ensure that the selected product is appropriate for the intended application.

Where professional installation, engineering assessment, building compliance or specialist technical knowledge is required, the customer should obtain appropriate professional advice.

Damage resulting from incorrect installation, unsuitable substrates, incompatible adhesives, improper storage, misuse or unauthorized modification is not considered a product manufacturing defect, subject always to mandatory Consumer rights.

14. B2B, Wholesale and Quotations

Business and professional customers may request quotations for wholesale quantities, projects, custom products, manufacturing, freight and other commercial requirements.

Quotations are subject to their stated validity period and may depend on stock, production capacity, minimum quantities, freight rates, technical feasibility and other conditions described in the quotation.

A quotation does not reserve stock or production capacity unless CorkMart expressly confirms the reservation in writing.

Specific B2B terms agreed in writing for a particular order take precedence over these general Terms for that order.

15. Intellectual Property and Customer Materials

CorkMart.com and its original text, photographs, graphics, logos, layouts, product content and other protected materials are owned by CorkMart, licensed to CorkMart or used with permission.

Website content may not be reproduced, distributed or commercially exploited without authorization except where permitted by law.

Where a customer submits artwork, logos, files or other materials for a custom order, the customer grants CorkMart the limited permission necessary to assess, produce and fulfil that order.

Customer photographs, testimonials or other materials will not be used publicly for CorkMart marketing solely because they were supplied for order fulfilment. Any public use will be subject to appropriate permission or the applicable terms of the service through which the content was submitted.

16. Third-Party Services and Privacy

CorkMart.com may use third-party services for payments, shipping, reviews, analytics, communications and other store functions.

Third-party services may be subject to their own terms and privacy policies.

CorkMart's processing of personal data is described in our Privacy Policy.

17. Liability and Events Outside Our Control

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including mandatory Consumer rights.

CorkMart is not responsible for loss or damage caused solely by circumstances outside its reasonable control, provided that CorkMart has complied with its applicable legal and contractual obligations.

Such circumstances may include serious transport disruption, natural disasters, government restrictions, strikes, customs disruption, widespread infrastructure failure or other events that CorkMart could not reasonably prevent or control.

Where such an event materially affects an order, CorkMart will take reasonable steps to communicate with the customer and provide the remedy required by applicable law and the circumstances of the order.

18. Changes, Applicable Law and Contact

CorkMart may update these Terms from time to time for future use and future orders.

Changes to these Terms do not retrospectively alter the agreed conditions of an existing order unless required by law or expressly agreed with the customer.

These Terms and contracts with CorkMart are governed by Portuguese law. For Consumers, this does not remove any mandatory protections available under the law applicable to them.

For Business customers, jurisdiction and any specifically agreed dispute provisions may also be established in the applicable quotation, purchase agreement or other written contract, subject to applicable law.
